Sending Notice of Sale and Deficiency Letters

A creditor client recently inquired as to the mailing requirements for sending a Notice of Sale letter and Deficiency Balance letters in the State of Indiana.  Although there is no statutory requirement that those letters be sent by certified mail, it is recommended that the creditor client send those letters BOTH by first class mail AND either certified or registered mail.  That way, even if the certified mail letter is refused, the client can show that the first class mail was not returned.

Fewer Americans Behind on Credit Card Bills

Due to an improving economy, fewer Americans are behind on their credit card bills, dropping from 1.27 percent in the second quarter of 2013 to 1.16 percent in second quarter of 2014. The rate is based on the ratio of borrowers 90 days or more delinquent on their general purpose credit cards.
